LIABILITY WAIVER & MEMBERSHIP AGREEMENT — THE WHITE TEE By becoming a member of The White Tee ("the Club"), you acknowledge and agree to the following terms: 1. ASSUMPTION OF RISK. I understand that golf simulator activities involve inherent risks including but not limited to: physical injury from swinging golf clubs, contact with equipment, slipping or falling, and equipment malfunction. I voluntarily assume all such risks. 2. RELEASE OF LIABILITY. I, on behalf of myself and my heirs, release The White Tee, its owners, operators, employees, and agents from any and all liability, claims, and causes of action arising from loss, damage, or injury while using the Club's facilities, equipment, or services. 3. MEDICAL FITNESS. I represent that I am in good physical condition and have no medical condition that would prevent safe participation in golf simulator activities. 4. FACILITY RULES. I agree to follow all Club rules, treat equipment with care, and respect other members and staff. Membership may be suspended or revoked for violations. 5. BILLING & CANCELLATION. Membership fees are billed monthly via Stripe. All memberships carry a 3-month minimum commitment beginning on the first billing date (opening day). Cancellation requests submitted before the 3-month minimum is fulfilled will not be honored. After the minimum period, I may cancel at any time with 30 days written notice; cancellation takes effect at the end of the current billing period. No refunds for partial months. 6. BOOKING POLICY. Bay hours are allocated monthly and reset on my billing anniversary. Unused hours do not carry over (except Signature tier). Bookings must be cancelled at least 24 hours in advance; late cancellations forfeit the hour. 7. GUEST POLICY. Members may bring guests during their sessions at staff discretion. Guest conduct is the member's responsibility. 8. INDEMNIFICATION. I agree to indemnify and hold harmless The White Tee from any claims or expenses arising from my actions at the Club. 9. GOVERNING LAW. This agreement is governed by the laws of the State of Florida. Disputes shall be resolved in Hillsborough County, Florida. 10. FOUNDER MEMBERSHIP TERMS. If you are enrolling as a Founding Member, the following terms apply and are incorporated into this agreement: (a) RATE LOCK. Your monthly membership rate is permanently fixed at the Founder rate in effect at the time of enrollment ("Locked Rate") for the specific membership tier selected. The Locked Rate applies only to your current tier and is non-transferable. (b) PERMANENT SPOT ALLOCATION. Founder spots are a limited, non-renewable resource. By enrolling, you permanently consume one (1) of the thirty (30) available Founder spots. This spot is retired upon enrollment and cannot be re-issued, resold, or reassigned under any circumstances. (c) NO REINSTATEMENT. If you cancel your Founder Membership for any reason — including but not limited to personal choice, financial hardship, relocation, or dissatisfaction — your Founder spot is permanently retired. You will not be eligible to re-enroll at Founder pricing. No exceptions will be made regardless of the reason for cancellation or the time elapsed since cancellation. (d) TIER SPECIFICITY. The Locked Rate applies exclusively to the membership tier selected at enrollment. If you upgrade or downgrade your membership tier at any time after enrollment, your Founder pricing is forfeited for the new tier. Tier changes will be billed at the then-current regular rate for the new tier. (e) PROGRAM CLOSURE. The White Tee Founder Membership Program is offered exclusively during the pre-opening period. The Club reserves the right to close the Founder Program at any time upon reaching capacity or at the Club's sole discretion. No new Founder memberships will be issued after program closure. (f) ACKNOWLEDGMENT. By accepting this agreement, I acknowledge that: (i) I have read and understood all Founder Membership Terms above; (ii) I understand that canceling my membership permanently forfeits my Founder spot with no right of reinstatement; (iii) I understand that my Locked Rate applies only to my current tier; and (iv) I am entering this agreement voluntarily with full knowledge of these conditions. This agreement is binding upon execution and remains in effect for the duration of membership.
